Knee Injury Claims

Our free compensation claims guide is for victims who have suffered a knee injury and want to know how to start a claim for compensation. Our offices are open 7 days a week so give us a call now.

Knee injuries are particularly painful but will usually heal by themselves in a short space of time. Some knee injuries, however, can be more serious and take a considerable period of time to heal, possibly even requiring surgery for the worst cases. While you are healing from your knee injury, you may find that you struggle to maintain a normal life, as your mobility may be severely restricted.

If you have developed a knee injury as a result of an accident that wasn’t your fault, call us on 0121 565 4317 or use our claims form to arrange your free, no obligation consultation. Our dedicated team of personal injury claims solicitors will discuss the details of your case, ensuring that we fully understand all of the aspects of your situation, including how your accident was caused, the full extent of your injuries and the impact that your accident or injury has had on your life. This allows us to give you the personalised advice and help that you deserve.

Common knee Injury Claim Types

Knee injuries are common following a variety of different accidents, including sporting accidents, slips, trips or falls, road traffic accidents and others. The most common types of knee injuries include:

  • 1. Sprains and strains

  • 2. Tendonitis

  • 3. Torn ligament, tendon or meniscus. The most common of these is the ACL (anterior cruciate ligament) injury, which usually occurs when the knee is under pressure to bend the wrong way or to twist in a direction that it cannot accommodate.

  • 4. Cartilage damage

  • 5. Dislocated patella (kneecap). This is a particularly serious knee injury and will often require surgery to put right.

  • 6. Fractured patella. This is when the kneecap develops a crack or even breaks apart. As with a dislocated patella, this is a serious knee injury and will often require surgery.

This list is not intended to be exhaustive. If you have any knee injury, included in this list or not, that occurred as a result of an accident that wasn’t your fault, please call us on 0121 565 4317 or claim online to arrange your free, no obligation consultation.

Compensation Amounts For Knee Injury Claims

It is impossible to give an accurate estimate of the likely compensation payment for your knee injury claim without knowing the full details of your case. This is why our expert team of personal injury claims solicitors take the time to fully understand your personal situation. In general terms, however, your compensation can be divided into two parts.

Compensation is awarded in personal injury cases such as yours to reflect the pain and suffering of the injury itself. This will usually be within guidelines published by the Judicial College (a national governing body). These guidelines give broad ranges for the amount of compensation due for different types of injury. The ranges are very broad in order to account for the highly individual nature of injuries and to ensure that the most appropriate sum will be awarded. Minor knee injuries have an upper limit of £10,960, whilst serious knee injuries can attract between £55,590 and £76,690. Our team of personal injury solicitors have years of experience interpreting these guidelines and will be able to give you a better idea of where on this scale your knee injury is likely to fall.

This is only the first part of your compensation payment, however. The other aspect that must be taken into consideration is how much it will take to get your life back on track. The purpose of compensation is to help you get as close as possible to the situation you were in before your accident happened. This part of your claim would include any loss of earnings you may have had as a result of your accident and knee injury, the loss of future earnings, if you are unable to continue in your previous career as a result of your injuries and any modifications you may require to help you adapt to your new life. This is likely to include expenses such as increased travel costs if you need to use taxis while your knee injury heals or physiotherapy if the NHS waiting lists in your area are prohibitively long. For more serious knee injuries, this could also include providing you with mobility aids to allow you to continue with as many of your previous activities as possible or adapting your home so that you are able to continue to live independently. For many people, this part of the compensation award can far exceed the amount given for pain and suffering according to the Judicial College guidelines. Our years of experience mean that our expert personal injury claims solicitors are able to highlight areas where you are making costly changes to your life that you deserve to be compensated for. This enables to make sure that you receive the full compensation you deserve.

No Win No Fee Knee Injury Claims

We understand that the period following a knee injury can be a stressful and financially difficult time. We believe that justice for your knee injury should not be dependent on whether you can make large, up front payments for expert legal advice. This is why we offer our services on a no win no fee basis to the majority of our clients. A no win no fee agreement allows us to act on your behalf without you having to pay anything up front. It also removes the risk and worry that comes from wondering how you might pay the legal fees if we are unable to get you the compensation you deserve. If we do not win your claim, you won’t have to pay anything. This means that you will never be left worse off because you made a knee injury compensation claim.

The no win no fee agreement also means you don’t need to worry that your legal fees may exceed the amount of compensation you are awarded. With the traditional payment model for legal services, the costs associated with making your claim could quickly exceed the amount of compensation you are awarded. Our no win no fee agreements cap our fees at a percentage of your compensation amount. This means that you can relax, knowing that you will always receive the lion’s share of the compensation you are awarded.

We are able to offer a no win no fee agreement to the vast majority of our clients, though there are some cases where this is not possible, for example when your claim is for medical negligence. If you would like to find out whether your knee injury compensation claim is eligible for our no win no fee agreement or if you have any other questions, call us on 0121 565 4317 or use our online claims form for a free call back.

How To Make Your Knee Injury Compensation Claim

Making a knee injury compensation claim with us is easier than you might expect. Once we are confirmed as your solicitors (usually by signing a no win no fee agreement) we are able to act on your behalf.

  • We will write to the personal or organisation responsible for your accident, notifying them that you are making a personal injury claim for your knee injury. We will ask them to admit that they were at fault for your accident (this is called accepting liability), outline the basics of your case and give them a deadline to respond to us.

  • If they accept liability for your accident, we would then move on to the next step. If they do not accept that they were at fault for your accident (this is known as disputing liability), we will gather evidence to support your claim. This could be through witness statements, arranging for experts to go the site of the accident and prepare a report or by getting copies of any police report, for example. The majority of cases in which liability was disputed initially end with the other party accepting liability once they are shown the evidence we have gathered.

  • Once liability has been determined, we will carry out the negotiations to agree how much compensation you deserve on your behalf. Although we will be conducting the negotiations, you will still have total control. We will inform you of every offer the other party make and give you our expert opinion as to whether the offer is a fair one or not. Although we will advise you regarding each offer, the decision about whether to accept or refuse will always be your decision and we will never try to pressure you in any way.

  • It is extremely rare that liability and the amount of compensation cannot be agreed between the two parties. If you are unfortunate enough to end up being one of those very rare cases, your case may need to go to court to find an agreement. If this happens, we will be with you throughout the process, making sure that you are fully informed about what is happening and why. The friendly support of our experienced team can make all the difference to how stressful your court appearance might be.
